Judge Aileen Cannon said the special counsel’s “conferral” with Trump’s lawyers is “wholly lacking in substance and professional courtesy.”

Cannon agreed with Trump’s lawyers that the special counsel should not have filed such a motion without meaningfully conferring with the defense, as the local rules require.

I don’t think there is a meaningful discussion to be had with the defense about making a defendant who constantly violates gag orders shut up.

Trump’s lead defense attorney Todd Blanche had asked the special counsel to wait until Monday to meet and confer – something the special counsel’s office declined to do because they said Trump had created a situation with his public comments that couldn’t wait the weekend to file.

Oh, they didn’t wait for the defense to delay and obstruct. Fuck Cannon.

The headline does not say it all.

“The Government moves to modify defendant Donald J. Trump’s conditions of release, to make clear that he may not make statements that pose a significant, imminent, and foreseeable danger to law enforcement agents participating in the investigation and prosecution of this case,” the filings from Smith said.

The New York Times explained the justification for the gag order request:

In a social media post on Tuesday, Mr. Trump falsely claimed that President Biden “authorized the FBI to use deadly (lethal) force” during the search.

By falsely suggesting that F.B.I. agents “were complicit in a plot to assassinate him,” prosecutors wrote, Mr. Trump exposed them “to the risk of threats, violence and harassment.”

To bolster their point, prosecutors reminded Judge Cannon that days after the search of Mar-a-Lago — a legal investigative step that Mr. Trump condemned on social media as an attack against him — an armed man in Ohio tried to shoot his way into an F.B.I. field office near Cincinnati.

The original article title specifically called out “Judge Cannon” and so should we all because she’s clearly neglecting her duty to cover for her candidate.

I still don’t understand how she hasn’t been removed from the bench for her blatant bias and incompetence.

She’s been careful to avoid making rulings because bad rulings can get her kicked off the case. Wherever possible, she reschedules, indefinitely postpones, or otherwise delays the trial because judges have a TON of say in how they schedule things.

She made a couple bad rulings early on and got reversed and admonished by a panel of judges. That’s two strikes.

She made another bad ruling about allowing redacted information in the defense’s filings to be seen by the public. Smith started the process of going to the other judges again, but she reversed her own bad ruling that time before it escalated to the other judges.

Now in this request she’s made another bad ruling. This may well be strike 3. Smith will certainly appeal to have the changes implemented. Whether he also brings up the other two incidents and asks for her to be removed is yet to be seen.

The thing is, you only get 1 chance to have the judge removed. And if it doesn’t work, you’re stuck with an even more hostile judge for the rest of the trial. Smith has to balance the need to have the trial before the election (already too late) against having enough justification for the extreme action of having a federal judge removed from a case against their will.

I don’t think you can hold it against Diane Feinstein. It’s getting damn hard to find replacement parts for the animatronics that keep her moving.

Lol, everyone seems to think this Judge should be removed because she won’t gag Trump like the other judge, but the other Judge is fine with all of his bias…seems about right
