I don’t know about being misleading, but I have to say that being constantly nagged to subscribe to Amazon Prime is really annoying.
Have had prime for the last 8 years but it’s too much now. And the constant nagging to get me back on it is annoying enough that I don’t even want to shop there any longer. Not that it’s much better of a company but I’ve switched to ordering shit on Walmart, their online store has mostly the same exact shit that Amazon has on it. If you live close enough to one then you get same day delivery on certain things too with thier Walmart Plus which is their version of prime.
But the judge apparently did not find Amazon’s denials completely persuasive. Viewing the FTC’s complaint “in the light most favorable to the FTC,” Judge John Chun concluded that “the allegations sufficiently indicate that Amazon had actual or constructive knowledge that its Prime sign-up and cancellation flows were misleading consumers.”
In his order (PDF link), Chun also denied individual motions to dismiss from Amazon executives Russell Grandinetti, Neil Lindsay, and Jamil Ghani, who oversaw Prime operations.
Good. I hope they all face charges.
As the FiveMacs pointed out, this isn’t criminal. The FTC is saying they will personally face fines. Personal liability. As opposed to Amazon’s corporate liability.
If they are liable the money goes to the government. Not individuals.
