Most people including me make the distinction based on the following criteria: Does the government have direct control over the broadcast? Is the channel allowed to criticize the government? Is founding decided by the government? Are you at risk for not having the same stance on a topic than the government? In the case of Germany, all of these are not true. In the case of authoritarian regimes, they are. That is the key difference.
